H.R. 4437: Border Protection, Antiterrorism, and Illegal Immigration Control Act of 2005

On December 6, 2005 House Judiciary Committee Chair Rep. Jim Sensenbrenner (R-WI) introduced the “Border Protection, Antiterrorism, and Illegal Immigration Control Act of 2005” (H.R. 4437). It was passed by the House Judiciary Committee along party lines on December 8, and is expected to go to the House floor on December 15. The bill includes many horrendous provisions that criminalize immigrants, deny due process rights, and harm U.S. businesses, communities, and families.

Take Action

Make a difference! Take action on H.R. 4437.

Among its many provisions, H.R. 4437 would:

  • Make it more difficult for legal immigrants to become U.S. citizens.
  • Disrupt American communities and put all Americans at risk by broadening the definition of smuggling to include anyone who aids or transports an undocumented immigrant.
  • Make everyone who comes to the U.S. to work subject not only to deportation but also imprisonment.
  • Disrupt the U.S. economy by creating an overly broad and retroactive employment verification system without creating legal channels for needed workers to work lawfully.

H.R. 4437 does nothing to resolve our nation’s immigration problems. Please take action today to stop this bill from passing.

The DREAM Act of 2005

National MEChA passed a resolution in support of the DREAM Act at the 2005 National MEChA Conference held at CSU Northridge. On Friday, November 18th, the DREAM Act was finally reintroduced as: S. 2075, the DREAM Act of 2005. The introduction of this bill gives new life to this legislation that has been on hold for the majority of the year.

However, the resolution passed by National MEChA stated that it would support the legislation as long as there was no military service included within it. According to Josh Berenstein of the National Immigration Law Center, “The features of the DREAM Act of 2005 are nearly identical to the version that passed the Senate Judiciary Committee last year by a 16-3 vote1.” This includes all the military service. So it appears that National MEChA does not officially support the DREAM Act in its current form. Yet, MEChA’s autonomy allows individual chapters to support the legislation; and many chapters are in full support.

If enacted, the DREAM Act would transform the lives of persons who were brought to the U.S. years ago as undocumented children and who have stayed in school and out of trouble since their arrival. It will become law if passed by both houses of Congress and signed by the President before the end of 2006.
